Client Liability Waiver & Terms of Service
1. Purpose
This Client Liability Waiver and Terms of Service (“Agreement”) is entered into between Club House Enc (“Company”) and the undersigned client (“Client”). The purpose of this Agreement is to outline the terms, conditions, and risk acknowledgment related to the use of Club House Enc’s facilities, services, and equipment, including infrared saunas, infrared light therapy, and cold plunge services.
By signing this Agreement, the Client acknowledges and agrees to comply with all policies and assumes all risks associated with participation.
2. Acknowledgment of Risks
Client understands that the use of saunas, infrared light therapy, and cold plunges involves inherent risks, including but not limited to:
Dehydration, dizziness, fainting, or heat exhaustion.
Burns, skin irritation, or sensitivity reactions from infrared exposure.
Cold-related injuries such as frostbite, hypothermia, or cardiovascular stress. ● Aggravation of existing medical conditions.
Client agrees to consult with a qualified healthcare provider prior to using any services at Club House Enc, especially if pregnant, elderly, or managing any medical condition (e.g., cardiovascular, respiratory, neurological, or circulatory disorders).
3. Assumption of Responsibility
Client voluntarily assumes full responsibility for any and all risks, injuries, or damages—known or unknown—that may result from participation in any activity or service at Club House Enc.
Client releases and holds harmless Club House Enc, its owners, employees, contractors, and affiliates from any liability, claims, or demands arising out of or related to use of the facility or participation in any of its services.
4. Health and Safety Requirements
Clients must disclose any medical conditions that could affect their ability to safely use Club House Enc’s services.
Clients must follow all posted safety instructions and verbal directions provided by staff.
Clients exhibiting illness, open wounds, or signs of infection may be denied use of certain services.
Consumption of alcohol or recreational drugs prior to or during use of any service is strictly prohibited.
Proper hydration before and after sauna or cold plunge use is strongly encouraged.
5. Service Guidelines
Infrared Sauna & Light Therapy
Sessions are limited to posted time durations.
Clients must use towels/barriers on benches at all times.
Exiting immediately is required if dizziness, nausea, or discomfort occurs.
Cold Plunge
Clients must shower before entering the plunge.
Maximum immersion time should not exceed facility guidelines (typically 5–8 minutes).
Clients with cardiac conditions or uncontrolled hypertension should obtain physician approval before use.
Do not enter the cold plunge alone; staff or another client must be nearby.
6. Personal Belongings
Club House Enc is not responsible for loss, theft, or damage of personal belongings brought into the facility. Lockers are provided for convenience but are not guaranteed secure storage.
7. Payment & Cancellations
All sessions must be prepaid or secured with a valid payment method.
Cancellations or reschedules must be made at least 12 hours in advance. All early cancellations lose credit.
Members can cancel up to 8 hours before the session to avoid fees.
Members will pay $20 for no shows/late cancellations.
Refunds are not provided for unused sessions, missed appointments, or early terminations.
8. Code of Conduct
Clients must maintain respectful behavior toward staff and other clients at all times.
Any inappropriate, aggressive, or unsafe conduct may result in immediate termination of membership or session without refund.
Facility cleanliness and hygiene standards must be upheld by all clients.
9. Consent to Use of Images
Client grants Club House Enc permission to use photographs or videos taken within the facility for marketing or promotional purposes, unless the Client opts out in writing.
10. Release of Liability
By signing below, the Client agrees to release, indemnify, and hold harmless Club House Enc, its owners, employees, and affiliates from any and all liability or claims for damages, personal injury, or death resulting from participation in any services, whether caused by negligence or otherwise, to the fullest extent permitted by law.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, and any disputes shall be resolved in San Diego County, California.
12. Acknowledgment & Signature
By signing below, Client acknowledges that they have read, understood, and voluntarily agree to the terms of this Agreement.
